YOUR ACCOUNT

You may need your own Derma Made account to use certain Derma Made Products & Services, and you may be required to be logged in to the account and have a valid payment method associated with it. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password.

REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT

Derma Made has the right but not the obligation to monitor and edit or remove any activity or content. COPYRIGHT COMPLAINTS

RISK OF LOSS

All purchases of physical items from Derma Made are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

SHIPPING

Derma Made offers free shipping to the customer within the United States on orders over $100. Shipping is typically done via the United States Post Office. Please note, Derma Made does not cover return shipping. At present, Derma Made does not ship to international locations.

FAIR USAGE

Derma Made’s fair usage policy (“FUP”) is designed to prevent fraud and abuse of Derma Made Products & Services. Derma Made’s Products & Services are for individual use only, and not for resale. The following is a non-exhaustive list of practices that would not be considered legitimate use:

a)     Re-selling Derma Made Products & Services, unless you are an authorized reseller

b)     Unusual purchasing patterns inconsistent with normal, individual use of Derma Made Products & Services

Derma Made may at its option, terminate or suspend its relationship with you, and cancel your orders of any Derma Made Products & Services immediately if it determines you are using the products and services contrary to this FUP.

ELIGIBILITY

You must be 18 years of age or older to visit or use the Derma Made Products & Services in any manner. By accepting the terms here, you represent and warrant to Derma Made that you are 18 years of age or older, and that you have the right, authority, and capacity to agree to and abide by these terms. You also represent and warrant to Derma Made that you will use the Derma Made Products & Services in a manner consistent with any and all applicable laws and regulations.

MONEY-BACK GUARANTEE

Derma Made offers a 100-day money-back guarantee on all of its products. If you are not happy with any of the products you purchase, please contact us within 100 days from your order date.

RETURNS, REFUNDS AND TITLE

If you are not satisfied with your purchase from dermamade.com, you may request a refund within 100 days of purchase. Refund requests must be made directly to us at suppot@dermamade.com. Unfortunately, we do not offer exchanges. All returns will be credited to the original method of payment. The refund will be issued upon processing of the returned item(s). Please include a copy of your purchase order with your shipment. We do not cover the cost of return shipping. The product you wish to return must be in the original bottle.

Derma Made does not take title to returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. We will not provide a refund for a request that is received by Derma Made more than 100 days after the date of original shipment. We also do not provide a refund for returned Products that are damaged due to misuse, lack of care, mishandling, accident, abuse or other abnormal use.

PRODUCT DESCRIPTIONS

Derma Made attempts to be as accurate as possible. However, Derma Made does not warrant that product descriptions or other content of any Derma Made Products & Services is accurate, complete, reliable, current, or error-free. If a product offered by Derma Made itself is not as described, your sole remedy is to return it in unused condition.

SANCTIONS AND EXPORT POLICY

You may not use any Derma Made Products & Services if you are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where you are using Derma Made Products & Services. You must comply with all U.S. or other export and re-export restrictions that may apply to goods and services.

DISPUTES

Any dispute or claim relating in any way to your use of any Derma Made Products & Services, or to any products or services sold or distributed by Derma Made or through dermamade.com will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement. There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Conditions of Use as a court would.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to us at 200 Howard ave #236, Des Plaines IL 60018. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. The AAA’s rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration and arbitrator fees will be governed by the AAA’s rules. You may choose to have the arbitration conducted by telephone, based on written submissions, or in person in the state of Illinois.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration we each waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

INDEMNITY

You agree to defend, indemnify, and hold Derma Made, its affiliates, licensors, suppliers, and third-party service providers, and each of their respective directors, officers, employees, contractors, agents, successors, and assigns (collectively, the “Derma Made Parties”) harmless from and against any claims, actions, demands, liabilities, and settlements including, without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your use of the Derma Made Products & Services or Contents, or your violation of these Terms. Derma Made reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the user, in which event the user will cooperate in asserting any available defenses.

APPLICABLE LAW

By using any Derma Made Products & Services, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the state of Illinois, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Derma Made.

SITE POLICIES, MODIFICATION, AND SEVERABILITY

Use of the Derma Made Software. All software used in any Derma Made Products & Services is the property of Derma Made or its software suppliers and is protected by United States and international copyright laws.
